PLEASE READ THIS TERMS OF SERVICE AGREEMENT CAREFULLY. BY USING THIS WEBSITE, ENROLLING IN COURSES, OR PURCHASING SERVICES FROM SHARMAN MUSIC ACADEMY (SMA), YOU AGREE TO BE BOUND BY ALL THE TERMS AND CONDITIONS SET FORTH BELOW.

This Terms of Service Agreement (the "Agreement") governs your use of the website and services offered by Sharman Music Academy ("SMA"). SMA reserves the right to change or revise the terms of this Agreement at any time by posting changes on this Website. SMA will alert you to changes by updating the "Last Revised" date at the top of this document.

I. SERVICES AND ENROLLMENT

Terms of Offer: SMA offers online music education, including live tutoring, recorded sessions, and digital learning materials (the "Services"). By enrolling, you agree to the terms set forth in this Agreement.

Customer Solicitation: Unless you notify our representatives of your desire to opt out, you agree to continue receiving emails, SMS, and call solicitations from SMA and its designated partners.

·        Opt-Out: You may opt out by (1) Using the link in any email, or (2) Emailing your request to help@sharmanmusicacademy.com.

Proprietary Rights: SMA holds proprietary rights to all course curriculum, teaching methodologies, and digital assets. You may not copy, record, redistribute, or resell any materials provided by SMA without express written consent.

II. SESSION CANCELLATION & ATTENDANCE

Your use of SMA services is subject to our Attendance Policy:

·        Punctuality: Students are expected to join the virtual classroom 5 minutes prior to the start time.

·        Cancellations: Students must provide notice at least 3 hours before the session. Failure to do so will result in the loss of that session credit.

·        No-Shows: Failure to attend without notice will be marked as "Absent," and the session credit will be forfeited.

·        Consecutive Absences: A maximum of 2 consecutive cancellations is permitted. Beyond this, SMA reserves the right to reassign your scheduled time slot.

III. WEBSITE USE AND INTELLECTUAL PROPERTY

Content: All text, graphics, and interactive layouts on this website are the intellectual property of SMA or its licensors and are protected by Indian and International law. User Conduct: You agree not to use the Website for illegal purposes. You will not:

1.     Disrupt the enjoyment of the Website by other users.

2.     Engage in "spamming" or unsolicited communications.

3.     Attempt to reverse-engineer or harvest data from the SMA platform.

4.     Defame, harass, or abuse SMA instructors or other students.

License: You are granted a limited, non-exclusive, non-transferable right to use the content on the Website for personal, non-commercial educational use only.

IV. DISCLAIMER OF WARRANTIES

YOUR USE OF THIS WEBSITE AND OUR EDUCATIONAL SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

SMA EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

·        The accuracy or timeliness of information provided on the Website.

·        Any specific musical result or skill level attainment (as progress depends on student practice and aptitude).

·        Uninterrupted access to the platform (though we strive for 100% uptime).

V. LIMITATION OF LIABILITY

SMA’S ENTIRE LIABILITY, AND YOUR EXCLUSIVE REMEDY, IS SOLELY LIMITED TO THE AMOUNT PAID BY YOU FOR THE SERVICES PURCHASED VIA THE WEBSITE DURING THE APPLICABLE BILLING CYCLE.

SMA WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM:

1.     The use or inability to use the Website or Services.

2.     Unauthorized access to your transmissions or data.

3.     The cost of procuring substitute services.

VI. INDEMNIFICATION

You will release, indemnify, and hold harmless SMA, its contractors, employees, and affiliates from all liabilities, claims, and expenses (including legal fees) arising out of:

1.     Your breach of this Agreement.

2.     Your use of SMA materials or intellectual property.

3.     Any data or information you provide to SMA.

VII. PRIVACY

SMA believes strongly in protecting user privacy. Please refer to our Privacy Policy, which is incorporated into this Agreement by reference.

VIII. GENERAL PROVISIONS

Force Majeure: SMA will not be deemed in default for any delay in performance due to natural disasters, acts of God, war, terrorism, strikes, or major internet infrastructure failures.

Governing Law & Jurisdiction: This Website originates from India. This Agreement will be governed by the laws of the State of Rajasthan. Any legal action related to this Agreement shall be brought exclusively in the courts located in Rajasthan.

Statute of Limitation: Any claim arising out of the Website or Services must be filed within one (1) year after the cause of action arose or be forever barred.

Termination: SMA reserves the right to terminate your access to the Website or Services if it reasonably believes you have breached any terms of this Agreement.

Assignment: You may not assign your rights under this Agreement. SMA may assign its rights at its sole discretion without notice.

BY USING THIS WEBSITE OR ENROLLING IN OUR ACADEMY, YOU ACKNOWLEDGE THAT YOU HAVE READ AND AGREE TO BE BOUND BY ALL TERMS AND CONDITIONS OF THIS AGREEMENT.
